Who is affected?

Apartments with more than three units, equipped with specific load-bearing components that rise over 6 feet from the ground, fall under this regulation. This includes decks, balconies, walkways, stairways, and their railings made of wood or wood-based products.

    Delay can be costly, both in terms of finance and safety. Schedule your inspection well ahead of deadlines. If your building was established before 2020, aim for a deadline well before January 1, 2025. For newer structures, initiate an inspection within six years of construction.

  • What are some examples of “Exterior Elevated Elements (EEE)”?

    Exterior Elevated Elements refers to load bearing components and associated waterproofing systems, which includes balconies, decks, porches, stairways, walkways, and associated railings.

  • What EEEs are subject to SB721 inspection?

    The Exterior Elevated Elements (EEEs) subject to the new requirements include those with a walking surface elevated more than six feet above ground level, designed for human occupancy or use, and supported by wood or wood-based products.

  • Who does this law effect? And what needs to be inspected?

    Apartments (with 3 or more units) that have load bearing components more than 6 ft above the ground with a walking surface (i.e., decks, balconies, walkways, stairways and their railings) supported by wood or wood-based products.

  • When is action or an inspection required?

    The first inspection must be completed by January 1, 2025 except for communities built on or after January 1, 2020 in which case the first inspection must be completed within six years. 

  • Who can help with SB721 Inspections?

    There are four professions that can perform the SB721 as provided in the list below. 15% of each type of EEE’s will be inspected, and the elected contractor will provide a stamped report for the city to record.  

    • Licensed Architect
    • Licensed Civil  or  Structural  Engineer
    • Licensed  contractor (A,B,or C-5) with at least 5 years of constructing  multistory wood frame  buildings.
    • Certified Building Inspector

  • Where do we find qualified inspectors?

    Empire works is happy to recommend one of our partnered engineers or architects to provide the association with a proposal to perform the inspection.

  • Why should we get this inspection now?

    While you do have until 2025 to do the inspections the availability of qualified inspectors will be sparse in the future as other associations/apartments plan to put it off. In addition, owners should already be conducting these types of inspections to ensure such components are safe and being maintained. 


    Associations/apartments that are not conducting such inspections are not only risking the potential safety of owners and their guests but may be exposed to potential liability.
